Another day, another attempt to interfere in the lives of Muslims and to give another bloody nose to Islam.  This time on the other side of the ring ready for battle with the Muslims, is a Muslim.  There is nothing the Islamaphobes like more than Muslim on Muslim bashing, they relish it because it means that they don’t have to get dirty and they can just watch from the sidelines.  From that position they can also offer great financial support and essential media airtime to their man (or woman in this case) to put forward their case.

Baroness Warsi, or to give her full name, Sayeeda Hussain Warsi has now launched an attack on the Muslims who practise the divinely sanctioned practice of polygamy.  She sees this blessing that Allah gave the Muslims as a real problem because it goes against “British law”  she says:

“There has been a failure on the part of policy makers to respond to this situation,”

I listened to Radio 5 Live this morning where she was a guest discussing this issue with the host and the public.  What came accoss in this programme were her generalisations on the reality of the practice stating that for every one woman happy with concept of polygamy there are at least 12 or more who are not. She made many more.

Whilst I except there are unfortunate situations where polygamy hasn’t been a happy experience for some, (that’s life) nobody can doubt that there are seriously unhappy people who practice the more common marital monogamy.

Moreover Baroness Warsi stated that in her view, which is shared by the state, that marriage can only between one man and one woman.  How is it then that the state has excepted single sex marriages?  I could put the same basic argument for Islamic polygamy that the sodomists put for theirs, that is, it is between consenting adults who love each other.  Why then is the state, or rather Baroness Warsi, more offended by this practice of polygamy by the Muslims?

We will be seeing this debate on our TV screens, radios and newspapers shortly headed by Ms Warsi, so be prepared. She calls herself a Muslim yet is activley working towards preventing the Muslims from practicing one of Allah ’s laws because she feels that UK law is superior to sharia and should take presidence over it.

Allah says:

“If ye fear that ye shall not be able to deal justly with the orphans, marry women of your choice, Two or three or four; but if ye fear that ye shall not be able to deal justly (with them), then only one, or (a captive) that your right hands possess, that will be more suitable, to prevent you from doing injustice.” (Qur’an 4:3)

We are also reminded by Prophet Muhammad that we should be careful when taking more than one wife:

“Whosoever had two wives and treats one of them more favorably than the other will come on the Day of Judgment bent to one side.” (Reported by Ahmad, Abu Dawud, An-Nasa’i and Ibn Majah)

So, Allah says we can marry more than one wife under certain strict conditions; Baroness Warsi is certainly brave to say no.

There seems to be a big hue and cry about Al Shabaab in Somlia across the net about their destruction of those graves that have been built upon.  Many people have resorted to the abuse of these brothers, who are waging Jihad fisabillah in Somalia, and in doing so they are displaying their ignorance of the details and of the fiqh.

Allah reminds us in The Noble Qur’an that those who fighting Jihad fisabilah are not harmed by these remarks as Allah Himself protects them.

O you who believe! Whoever from among you turns back from his religion (Islam), Allah will bring a people whom He will love and they will love Him; humble towards the believers, stern towards the disbelievers, fighting in the Way of Allah , and never afraid of the blame of the blamers. That is the Grace of Allah which He bestows on whom He wills. And Allah is All-Sufficient for His creatures’ needs, All-Knower.    (Sura Maidah 54)

I have found that it is the same individuals, who consistently huff and puff at the Mujahadin, that display even worse characteristics by denying legitimate jihad wherever it is being fought.  This flowery and limp wristed attitude towards Islam is very harmful.  

Hadhrat Maulana Yusuf Ludhianvi writes in his book Ikhtilaf-e-Ummat Aur Sirat-e-Mustaqeem about the impermissability of building over graves with structures etc.

The Hadith wherein Nabi (sallAllaahu alaihi wasallam) had prohibited the building up of solid walls around graves has been mentioned previously. Our Aimmah of the Ahle Sunnat have ruled this act as being Haraam based on the above-mentioned narration. 

Imaam Muhammed (rahmatullahi alaih) – one of the senior students of Imaam Abu Hanifah (radhiAllaahu anhu) – states:

“We do not deem as correct (and permissible) to cover the grave with more sand than what was taken out therefrom. We regard as Makrooh (e-Tahrimi) the building up of (walls around) graves and plastering them (with mud or concrete). Indeed Nabi (sallAllaahu alaihi wasallam) had forbidden the building up of and solidifying graves. This is our Mahdhab and this is Imaam Abu Hanifah’s view also.” [Kitaabul Aathaar]

Since our Nabi (sallAllaahu alaihi wasallam) had instructed Hadhrat Ali (radhiAllaahu anhu) to flatten all those graves which were high, Imaam Shaafi (rahmatullahi alaih) states that based upon this narration, he noted that in Makkah Mukarramah, the Aimmah had given the instructions that all built up graves be broken down. [Sharah Muslim Nawawi, page 312, vol.1]

From this we can safely gauge that those Auliyaah whose graves have been built up and solidified, they are completely free and not responsible for such accretions and innovations. They had never desired, liked or encouraged such actions. The responsibility of these innovations must be borne by the worldly leaders and rulers, who had acted in contradiction of the blessed words of our Nabi (sallAllaahu alaihi wasallam) and innovated these detestable actions. Nowadays people have begun to accept these tomb s and built up graves as being a standard and a measure of piety and Wilaayat. You may also have experienced for yourselves where some tradesman used a dream or „Ilhaam? (Divine Inspiration) as a proof for building up some fake grave, wherafter the ignorant ones would go and worship at that grave. 

Inna Lillaahi Wa Inna Ilaihi Ra`jeoon. Nevertheless, almost every reputable Hanafi Kitaab, for example, Aalimgiri, Qaadhi Khaan, Durrul Mukhtaar, Kabeeri, etc. have stated this act as being totally impermissible. Allaamah Ibn Aabideen Shaami (rahmatullahi alaih) states:

“As far as building up of graves, I have never seen consent being granted for it anywhere.” [Page 237, vol.2]

Hadhrat Thanaaullaah Paani Pati Hanafi (rahmatullahi alaih) states: “And those graves (tombs) of the Auliyaah that are built up high, and lamps are lit there and all other such actions which take place there, are ALL HARAAM.” [Mala Budda Minhu, page 84]

These Somali brothers are upholding the shari’a and are fighting to establish it further.  Mistakes will be made along the way, this isn’t one of them,  May Allah excuse any error in their effort and may He bless them with victory. Amin

Having "slept on it" I have come to the conclusion that although the style that I wrote in, regarding those who insult Prophet Muhammad , was a little raw and contained some error in tone etc, I really feel that the essence was correct, the fiq was correct and the principle was correct – despite what people think.  You see, I believe my original reaction was the correct reaction, even though it was a really emotional reaction to what I found to be an abhorrent and totally ignorant and unacceptable article by Inayat Bungawala. 

The truth and undeniable fact is that the crime of intentionally insulting Prophet Muhammad is one of the most serious of all crimes, one deserving of the ultimate punishment under the Shari’a law.  This is not my opinion, it is not my suggestion I was/am merely repeating and stating the united position of all of the most respected scholars of Islam over the past 1400 years.

Lambasted, as I was; scoffed at, as I was – my own opinion regarding the ruling of such crimes never entered the arena. My opinion was evident in my personal attack upon Inyat's limp wristed and ignorant words of support for those who do commit such major crimes.

So, "shooting the messenger," (me in this case) became a good thing to do because it was wrongly viewed that I was an extremist with extreme and un-Islamic views. I did mention in the original post that I feared being labeled "extremist," and indeed I was.

Please allow me to present the opening paragraphs of the section entitled The Judgement of the Shari'a regarding someone who curses or disparages the Prophet, from the book "Messenger of Allah:  Ash-Shifa of Qadi 'Iyad" 

This book is extremely well known and is regarded by all as one of the best books ever written about the nature of Prophet Muhammad .  It was taught last year by Shaykh Muhammad al-Yaqoubi in Birmingham, UK.  The author lays out the position of the Ullema regarding those who insult Prophet Muhammad and his own personal view is not expressed.

Know that all who curse Muhammad, may Allah bless him and grant him peace, or blame him or attribute imperfection to him in his person, his lineage, his deen or any of his qualities, or alludes to that or its like by any means whatsoever, whether in the form of a curse or contempt or belittling him or detracting from him or finding fault with him or maligning him, the judgement regarding such a person is the same as the judgement against anyone who curses him. He is killed as we shall make clear. This judgement extends to anything which amounts to a curse or disparagement. We have no hesitation concerning this matter, be it a clear statement or allusion.

The same applies to anyone who curses him, invokes against him, desires to harm him, ascribes to him what does not befit his position or jokes about his mighty affair with foolish talk, satire, disliked words or jies, or reviles him because of any affliction or trial which happened to him or disparages him, because of any of the permissible and well-known human events which happened to him. All of this is the consensus of the 'ularna' and the imams of fatwa from the time of the Companions until today.

Abu Bakr ibn al-Mundhir said that the bulk of the people of knowledge agree that whoever curses the Prophet is killed. These include Malik ibn Anas, al-Layth, Ahmad ibn Hanbal and Ishaq ibn Rahawayh, and it is the position of the Shafi'i school. Qadi Abu'l-Fadl said that it is based on the statement of Abu Bakr as-Siddiq. His repentance is not accepted. Something similar was stated by Abu Hanifa and his people, ath-Thawri and the people of Kufa and al-Awza'i about the Muslims. However, they said that it constitutes apostasy.

At-Tabari related something similar from Abu Hanifa and his companions about anyone who disparages the Prophet, proclaims himself quit of him or calls him a liar.

Sahnun said about those who curse the Prophet, "This is apostasy in exactly the same way as heresy (zandaqa) is. Therefore there is some dispute about whether such a person should be called to repent (as a Muslim) or whether he is an unbeliever. Is he to be killed by a hadd-punishment (as a Muslim) or for disbelief?" We will make this clear in Chapter Two. We do not know of any dispute among the 'ulama' of the community and the Salaf regarding the permissibility of shedding his blood.

Several people have mentioned that the consensus is that he is to be killed and considered an unbeliever. One of the Dhahirites, Abu Muhammad ibn Ahmad al-Farisi, however, indicated that there is some disagreement about whether to consider someone who belittles the Prophet as an unbeliever. The best-known position has already been stated.

Muhammad ibn Sahnun said that the 'ulama' agree that anyone who reviles the Prophet and disparages him is an unbeliever and the threat of Allah 's punishment is on him. The community's judgement on him is that he be killed. Anyone who has any doubts about such a person's disbelief and punishment is also an unbeliever. For a proof of this, Ibrahim ibn Husayn ibn Khalid, the faqih, uses the instance of Khalid ibn al-Walid killing Malik ibn Nuwayra for referring to the Prophet as "your companion."'

Abu Sulayman al-Khattabi said, "I do not know of any Muslim who disagrees about the necessity of killing such a person if he is a Muslim."

Ibn al-Qasim reports from Malik in the book of Ibn Sahnun, the Mabsut, and the 'Utibiyya and Ibn Mutarrif relates the same from Malik in the book of Ibn Habib, "Any Muslim who curses the Prophet is killed without being asked to repent."

I was not and I am not encouraging any physical retribution upon those who insult the Prophet Muhammad as it would not be right.  It would cause much damage to the individual and to the Muslim community as a whole.  I am merely reminding everyone, including myself, of the seriousness of this crime by setting out the position of the scholars.

If this is the position of the scholars regarding that person who insults our beloved Prophet Muhammad , then what of that person who assists on defending that person’s right to insult the Messenger of Allah ?  Putting to one side what the court of Queen Elizabeth says about his right to defend the slanderers, what is his position in the court of Allah ?  Does he have that right in the court of Allah ?

We are taught to have love for the Prophet Muhammad and have Taqwa (God consciousness, fear of God) what type of Muslim would not be physically hurt by the insults directed at the Messenger of Allah ?  And what type of Muslim does not think about Allah when he fights for the rights of the slanderers, the abusers, the haters of Islam, Allah and Prophet Muhammad to continue their crusade?

It is nothing short of disgraceful.

We should be very careful when we join the chorus singing freedom of speech when it comes to the Messenger of Allah , it is not a game, it is not a small issue and it is not about so called freedoms of expression or speech in the West.  It IS about what is right and wrong in the court off Allah .

People are so obsessed by saying things because they could, they don’t stop and think about whether they should.

The following has been taken from the Waqif ul Ulama website and it concerns the sighting of the Hilal

• All efforts will be made to sight the moon locally, acting upon the clear instruction of our beloved Nabi sallallahu alaihi Wassallam ‘‘don’t fast until you see the new moon, and don’t break it until you see it. If then, there is cloud over you, count in full’ (Sahih Al Bukhari Volume 1 Page 256).

• To achieve this, help, can be taken from the experts in the field of astronomy, but the judgment will never
ever under any circumstances be dependent upon them. The Judgment will always be upon actual sighting

• If there is possibility of a sighting in U.K. (Imkan-e-Ru’yat) at the end of the 29th day after Maghrib, if the moon is on the horizon, all efforts will be made to sight the moon locally.

• If the moon is not sighted in the U.K. then we can accept the sighting of another country to the East of UK or Morocco, On the condition that the actual sighting information is correct, reliable and verified, (Muhaqqaq Ru’yat e Basari) and the Moon sighting criteria followed by that country, is accepted by our Holy Shariah.

• If at the end of the 29th day, there is no possibility of sighting the Moon in the UK. i.e. the Moon is not on the horizon, we will still follow the Sunnah and exhaust all efforts in trying to sight the Moon. However on this occasion, the testimony of one or two witnesses will not be deemed as acceptable, rather, the testimony of a large group will be necessary (Jamme Ghafir) as is the case, when the skies are clear. If this condition does not exist (i.e. if the moon is not sighted anywhere or when there was no possibility of moon being sighted and testimony of a large group is not there), or if we do not receive correct sighting report (Muhaqqaq Ru’yat e Basari) from another country to the East of UK or Morocco then thirty days will be completed for that Month.

“There is nothing wrong in seeking help from the astronomers for possibility of sighting or for finding out the age of the moon” Darul Iftaa, Jamia Farooqia, Karachi Fatwa issued 19/04/1428.

“What is decided is, that if one is not dependent on the astronomers only, rather on actual sighting, then there is no difference of opinion on using astronomy as a tool or help”. Darul Iftaa Jamia Al Rasheed. Fatwa issued 01/06/1428 H

Question asked to Shaykh Bin Baz:

Is it correct that the Hanaabilah are the only Salafi’s? And what is the reality of as-Salafiyyah?

This is not a correct statement; for indeed the Salaf us-Saalih (the pious predecessors) are the Sahaabah may Allah be please with them, and whosoever followed their way, from the Taabi?een and the atba?at-Taabi?een, from the Hanafees and the Maalikees and the Shaafi?ees and the Hanbalees; and other than them from those whom traversed upon the truth and adhered to the mighty Book and the pure Sunnah (Shaykh `Abdul-`Azeez Bin Baz courtsey of fatwaislam)

Shaikh Muhammad Ibn Uthaimeen mentions Taqleed is done in two cases:

1) when the muqallid is an aamee (a common person) who does not have the ability to aquire knowledge of the shariyah ruling by himself. So taqleed is obligatory upon him, due to the saying of Allah ‘ask the people of knowledge if you do not know.’ So he does taqleed of one whom he considers to be a person of knowledge and piety. If there are two such people who are equal in his view, then he chooses any one of them.

2) The mujtahid when he encounters a new situation, for which an immediate solution is required, but it is not possible for him to research into this matter. So in this case he is permitted to perform taqleed.(Shaykh Muhammad Ibn Uthaimeen Source: Al-Usool min `Ilimil Usool)

Shaykh Mohammad Saleem mentioned the following, regarding the types of ring tones a Muslim should have on his mobile:

One should endeavour to switch off our mobiles when coming into the Masjid. If we leave them on silent then at least wait till you go outside before looking at them. It is haraam to have musical ring tones. (Even though those who do this have good intentions) it is also inappropriate to have Adhaan or Qiraah as ring tones. The Qur’aan and Adhaan were not sent to this world in order to inform us that a friend of ours is ringing us on our mobile.

The plan to fine those whose mobile phones ring during the namaz or prayers has been welcomed by public and is expected to spread into other parts of the province.
MUS – The mufti or senior Muslim cleric for the southeastern Turkish city of Mus has ordered that anyone whose mobile phone rings while they are praying in one of the region’s mosques should pay a fine of 10 Turkish lira. Mufti Ali Melek said that the money raised from the fines would be go towards the needs of Mus’ mosques. Currently, the fine is limited to the city of Mus but soon would spread throughout the province, according to Melek.

According to Cellular News, an imam at a Mosque in Saudi Arabia issued a fatwa against mobile phones after one rang during prayers on Saturday, playing Arabic pop music. “The fatwa states that the next time somebody allows their phone to go off in the congregation, the imam could throw the guilty person out of the mosque.”

Question:

Is there anything wrong with using mobile phones which play tunes, because these tunes are a kind of music, or not? In fact it is possible to avoid this problem by using a mobile telephone whose ringing tone is a verse of Qur’aan.

ANSWER:

Praise be to Allaah.  The Prophet (peace and blessings of Allaah be upon him) stated that musical instruments are haraam when he said: “There will be among my ummah people who will regard as permissible adultery, silk, alcohol and musical instruments.” Narrated by al-Bukhaari, 5590.

This hadeeth indicates that musical instruments are haraam in two ways. Firstly, the Prophet (peace and blessings of Allaah be upon him) said “they will regard as permissible,” which clearly indicates that the things mentioned – including musical instruments – are forbidden in sharee’ah but those people will regard them as permissible.  Secondly, musical instruments are mentioned alongside things which are definitively forbidden, namely adultery and alcohol. If they were not haraam, they would not be mentioned alongside these things. (al-Silsilah al-Saheehah by al-Albaani, 1/140-141).

Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said: This hadeeth indicates that musical instruments are haraam. (Majmoo’ al-Fataawa, 11/535).

It is possible to do without these haraam tunes by setting the phone to ring with an ordinary tone, or something else that is not regarded as a musical tune.

The Standing Committee for Issuing Fatwas was asked about the ruling on musical tunes on mobile phones. They replied:

It is not permissible to use musical tunes for telephones or any other devices, because listening to musical instruments is haraam, as is indicated by the evidence of sharee’ah. It is possible to do without them by using the ordinary ringing tone. And Allaah is the Source of strength.  Majallat al-Da’wah, issue no. 1790, p. 42.

The questioner mentioned that it is possible to set the ringing tone as a verse of Qur’aan, but it is better not to do that, because there is the fear that this may be a kind of disrespect towards the Holy Qur’aan. Allaah revealed the Qur’aan to be a Book of guidance showing the right way, to be recited and pondered and acted upon, not to be a means of alerting people. It is sufficient for the questioner to set his phone to an ordinary ringing tone. And Allaah knows best.

That is your opinion of what we hear of the annoying ringing of mobile phones with a musical ring and their being so popular that they are even heard in the mosques?.

Answer:
Praise be to Allaah.

Setting mobile phones to ring with a musical tone is reprehensible and haraam, and it is even worse and more haraam if that happens in the houses of Allaah, namely the mosques, because that is openly committing falsehood and haraam in that place, so the sin of the one who brings it with him is even worse in the mosque. It is known that the Prophet (peace and blessings of Allaah be upon him) stated that musical instruments are haraam, meaning the instruments that give these musical sounds. These mobile phones have these sounds recorded in them which is repeated every time a call comes to the owner of the phone.  I wonder what will be recorded in the record of deeds of those who make their mobile phones play music in the houses of Allaah during the prayer, and disturb themselves and others, and make the voice of falsehood and the musical instruments of the Shaytaan echo loudly in the houses of Allaah.

Do they not fear their Lord and repent to Him and give up what they are doing and change this evil, especially when there is a permissible alternative in the other regular, non-musical sounds that they can choose for the phone’s ring?

We should note that the ringing of the telephone, even if it is a permissible sound, should still be turned off before entering the mosque, so that it will not disturb the worshippers.

And Allaah is the One Whose help we seek and to whom we complain. There is no power and no strength except with Allaah.

Qur’anic Ringtones Haram Arab News

MAKKAH, 9 November 2007 – The Islamic Jurisprudence Council banned the use of the verses of the Holy Qur’an as ringtones for mobile phones because it impinges on the sacred character of the Muslim Holy Book, the Saudi Press Agency reported yesterday.

“It is demeaning and degrading to the verses of the Holy Book to stop abruptly at the middle of a recitation or neglecting the recitation, as happens when they are used as ringtones in mobile phones. On the other hand, recording the verses from the Holy Qur’an in phone sets with the intention of recitation and listening is a virtuous act,” the scholars attending the council said in a statement.

During the six-day meeting of the council in Makkah, which began Nov. 3 under the chairmanship of Grand Mufti Abdul Aziz Al-Asheikh, 70 Muslim dignitaries and scholars tackled a number of important issues. On behalf of Custodian of the Two Holy Mosques King Abdullah, Makkah Gov. Prince Khaled Al-Faisal opened the first session of the council.

640. Narrated Anas ??? ???? ??? : The Prophet ??? ???? ???? ???? said, A Muslim whose three children die before the age of puberty will be granted Paradise by Allâh due to His Mercy for them. (2:340O.B.)
